People are often deterred from using a litigation solicitor because of fears over the cost. It is, however, usually worthwhile at least speaking to a litigation solicitor to see whether the law is on your side and your case is financially justifiable and to find out what your options for funding are.

The most favourable way you could find of paying for your litigation solicitor would be Legal Aid, otherwise known as community funding. This is, however, increasingly rare and requires you passing a means-based test. It is usually only available for matters such clinical negligence with the likely recipients being children and people on welfare benefits.

Legal expense insurance would most likely be the next thing a litigation solicitor would recommend depending on your circumstances. This can be bought as a stand-alone policy but for personal matters individuals often find they have one attached to an existing policy. So, for instance, if you were in a road traffic accident or were suing a tour operator, your litigation solicitor might be covered by the related insurance.

'No win, no fee' payments, also known as conditional fee agreements, are an increasingly popular way of paying for a litigation solicitor. Under such a scheme you would only pay your solicitor's fees if you won your case. As appealing as this sounds it is qualified by the fact that if you lose you could be liable for the other party's legal costs. To mitigate this risk it is possible to take out after-the-event insurance.
